South Korea's highest court decriminalises adultery

The Constitutional Court of (South) Korea decriminalised adultery in that jurisdiction on 26 February 2015. However, adultery remains a crime in two Asian states being Taiwan and The Philippines. Adultery is also a crime in some of the United States of America (for example, in the state of Massachusetts). Although no European country criminalises adultery it can be one of the grounds for divorce (for example, adultery can be the basis of a divorce in England and Wales).

The possibility of criminal or other civil sanctions as the result of an extra-marital sexual relationships is a fact that may surprise many Australians where the "no fault" concept of divorce has existed since 1975. However, people with links to places that still regard adultery as relevant to the rights that flow from marriage breakdown ought to obtain legal advice in all relevant jurisdictions in order that the legal consequences of adultery can be appropriately dealt with.
